Subject: Annual Meeting of the 2021 HOA Members


Annual Meeting of the 2021 HOA Members is Postponed Indefinitely.  This is the annual meeting where the HOA Board of Directors (BOD) turns over control of the HOA to the members.  It was scheduled for Thursday, 11 February this year. The members would normally control the agenda and vote on any business that they propose.  To do so, we must have a quorum of members representing at least 30% of our members’ residences.  Otherwise, no business can be conducted. As far back as Mike and I can remember, there has never been a quorum present at any of our previous annual meetings.  So we typically give the various committee reports and that is all that is addressed.  Because the ballroom is currently restricted to not more than 75 people, it will not accommodate the required quorum.  Therefore, the HOA BOD voted last week to postpone the 2021 meeting of the HOA Membership until the restrictions on the capacity of the ballroom are fully restored and can accommodate the necessary quorum.  We will give a thirty day notice of the rescheduled meeting.  The schedule of 2021 Regular HOA Directors meetings is not changed.

Subject: 2021 Hamptons HOA Board of Directors (BOD)

2021 Hamptons HOA Board of Directors (BOD).  Just prior to an emergency meeting Thursday evening I had the honor of installing the four newly elected members of the Hamptons HOA BOD.  Newly elected Directors include Kathy Hall, Mary Kay Colclaser, Dave Stuart, and Darry Armstrong.  These new Directors didn’t waste any time getting down to business.   They joined returning Directors Denny Flynn, Gary Hubbard, Mike Barry, and Rich Moyer in appointing our ninth and final member of the 2021 BOD, Kathy Wright.  Having worked in various roles with these new Directors over the past year, I assure you that these may be some of the most energetic and capable people to ever step up and run you HOA.  Your HOA is in very good hands, indeed.  Congratulations to each of the new Directors!

Your HOA President’s Comments
 
Back on the 2nd of July I wrote a note to let everyone know that even though the HOA Board of Directors could not regularly meet, we were still working for you behind the scenes.  Back then, nobody knew how long the virus would be around; today, we still don’t know.  I want to take this opportunity to bring everyone up to date on what we have been doing behind the scenes.  

HOA Emergency Powers. Most of the Florida HOAs were experiencing the same problems we were in terms of not being able to meet.  Recently, the FMO lawyers suggested a remedy to the problem that included a change to our HOA By Laws.  We drafted and adopted this change and were able to meet and conduct routine business of the HOA even though members still cannot be present.   We held our first meeting 1 October.  We took over two hours to approve the 2021 budget and go over everything your HOA is working on.

Statutory Committee.  The Statutory Meeting is the yearly meeting between five representatives of the HOA and Sun leadership to negotiate the increase in our lot rent.  We also address many of the problems that we have experienced throughout the year to Sun leadership.  In April, the five of us met to discuss and develop our strategy for this year’s meeting.  As a result, I sent a letter to Sun corporate offices in July to present our case that any 2021 lot rent increase should be far less than the 4% increase they have historically imposed.    We believe strongly that the residents’ quality of life has diminished during the pandemic enough to warrant the requested reduction.  As you know, Sun responded somewhat favorably with a 3.5% increase for 2021.  Although this increase is below the traditional 4% that Sun has imposed in the past, we still tried to get it reduced even further.  We met with Sun's leadership team late this month to negotiate an increase less than 3.5%.  The Sun representatives would not negotiate us at all, so the lot rent for 2021 will increase 3.5% despite our best efforts.  But that’s not the bad news.  The senior Sun representative advised us that beginning in 2022 and for the foreseeable future beyond they will intend to raise the lot rent by 5% each and every year.  

Short Term Rental Rule Changes.  As previously agreed by Sun, the HOA was attempting to review the entire set of Hamptons Rules and Regulations.  This was a monumental task that would have further delayed approval and implantation of the rule preventing short term rentals.  Therefore, on 1 June I submitted the rule requiring a minimum ninety day lease, along with a few lesser recommendations.  I asked that Sun update us on status/plans for pending and future rules changes at our recent Statutory Meeting.  Sun representatives said that this issue will be addressed in 2021.
 
Resident Survey Results/Facebook.  In July I commissioned a survey of all the residents to determine how the HOA can improve our service to the community.  The Resident Survey clearly reveled that communications with and among the residents was the number one thing on the residents’ minds.  We developed a plan to improve communications throughout the entire community to include clubs, activities, and charities via a HOA sponsored Facebook account.  Our announcement in the November Hampton Herald covers this very well.  You can always find old copies of the Herald on our website (www.flhamptons.com).

Nominations/Election.  Our 2021 election for Directors of the HOA will soon be upon us.  The cutoff for nominations will be at our regular Board of Directors meeting on 7 January 2021.  Conrad Gallant is leading the nomination committee in a search for anyone who is interested in serving as a Director of the HOA.  If you are interested in serving, please contact Conrad.  I must point out that the current Board of Directors does not reflect the demographics of the community.  We only have one woman on the Board and no part-time residents at all.  Both of these important demographics offer unique and valuable insights concerning community matters.  I encourage each of you to consider serving on the Board.  The election will be held on 21 January 2021.  A recent change to Florida laws requires that 20% of eligible members must vote for an election to be valid.  The legislature did not offer any remedy if we do not meet the 20% threshold.  So it is more important than ever for members to take part in our HOA election.  Those Directors who are elected will be sworn in immediately following the Annual HOA Membership Meeting on 10 February 2021.

Who has the real power in The Hamptons?  The HOA does not have the power to tell Sun what to do.  The HOA does not have any power over the residents.  In fact, the HOA must walk a fine line when dealing with Sun management and the residents.  All we can do is foster a sense of cooperation among all parties.  We constantly work to accomplish this.  So typically Sun gives us some of what we ask from them but they don’t give us everything we want.  You may not realize that in order for the HOA to take any sort of legal action against Sun, we must first secure a petition to do so that is signed by more than 50% of the residents.  Sun often asks us how many members we have.  They are measuring our power.  In 2020 we had just over 50% of the residents as members; not a very big threat to Sun when we can only muster 50% membership.  I am sure that they measure our risk to Sun as very low.  I remember when we had about 70% membership when Sun first took over the community.  From my experience, Sun was easier to work with and more responsive than they are now.  The point is we had more leverage over Sun because our membership was much higher.  So who has the power in The Hamptons?  The residents do!  The HOA gleans all of its power from the residents who join the HOA.  You are the only source of power we have.  I am sure you want your HOA to be in a strong position when they are trying to make things better in the Hamptons?  Please join.

Hamptons HOA Announces Hampton Homeowners Facebook Group

You Spoke . . . We Heard You . . . Now What???

 
During August, your Hampton HOA collaborated with Sun Communities to sponsor the Hampton Resident Survey.  We appreciate those who responded and we intend to use your responses to help us plan and prioritize our agenda for the upcoming season.
 
We are still compiling the results, but one thing is clear – we must do a better job of communicating with the residents of the community.  You want more and better communication from the HOA, and you want a method by which you can communicate with the HOA and other residents on issues specific to the community.  We heard you and we are taking steps to improve communication within the community.  
 
First, we are beta-testing a new email distribution method.  Our previous method was a tedious and time-consuming process, and was inconvenient and difficult to use.  Our new email distribution method saves resources and allows us to distribute information more frequently.
 
Next, to allow for communication from you to us and among the residents, we have launched a new Facebook Group – the Hampton Homeowners Facebook Group.  This group is for owners of or residents in homes in The Hamptons only.  This is similar to other Facebook groups to which you may belong.  You must apply for membership in order to read comments or to post comments, but membership will be approved for anyone living in the Hamptons.  
 
What makes this Facebook group different from the other Hampton Facebook groups and different from Nextdoor is that this group is exclusive – no one outside of the community will be able to read your comments or respond to them.  The comments will be available to be seen by your HOA Board Directors and group members who will be able to respond to your comments, and it is the method by which your HOA will distribute most information – especially the information that may not warrant an email.  We encourage other groups in the Hamptons use our new Facebook Group for that purpose as well.
 
To be a part of the new email distribution method, you have to do nothing.  If your email is on file with the HOA, your email address will transfer to the new email client seamlessly.
 
To access our new Facebook group, go to the HOA website at www.flhamptons.com and click on the Facebook information.  This will explain how to access the Facebook group.  As long as you are a resident or homeowner, your request for membership will be approved as soon as possible.  It is important that you be a member of the Hampton Home Owners Facebook Group to stay up on communication the moment the communication is released.
 
Thank you again for completing our recent survey.  We are committed to using your responses to help us as we pursue the issues you deem to be important.  We may be distributing additional surveys from time to time and hope you will continue to give us your honest feedback.

Subject: HOA Notes

Your HOA Board has been working on issues for you as we prepare for a new membership season – Oct 1, 2020 thru Sept 30, 2021.  The final membership number for the season ending Sept 30, 2020 is 426 (51.4 % of eligible home sites).  Budget planning is in process also for this next calendar year.  Owners of 33 new home purchases have been welcomed between April 1, 2020 and September 10, 2020. 
 
Results from our recent Resident Survey are being tabulated and categorized.  There were 306 resident respondents to that survey and there were 5,814 individual response lines of data.  Stay tuned for those results as soon as they are reviewed by the HOA Board and then communicated to our residents.  Also stay tuned to our new communication tool – HOA sponsored – The Hampton Homeowners Facebook Group.  Some details will be revealed in the October Hampton Herald.
 
The Hampton HOA Statutory Committee is due to meet with applicable Sun Communities management staff in October 2020.  Additionally all residents should be receiving via postal mail notices of 2021 rent increases in early October.  As of this date and time I (Mike Barry) do not know what that rate will be.

Florida Housing’s Coronavirus Relief Fund for Impacted Homeowners and Renters
Governor DeSantis has authorized $120 million of the State of Florida’s Coronavirus Relief Fund (CRF) allocation to assist Floridians that have been negatively impacted by the COVID-19 pandemic. It is intended for those struggling to pay housing expenses such as: rent, mortgage payments, and emergency repairs that will keep families stably and safely housed. This program may be used by manufactured home owners in land leased communities as well as for those directly renting manufactured homes. In general, your income must be no more than 1.2 times the median income for your area and your income has been adversely impacted by the COVID-19 pandemic.

Subject: Hamptons Resident Survey


Fellow Hamptonites,
 
Please note that the text below is a little bit different than the full page survey announcement that was included in the August 2020 Hamptons Herald. I added a couple of clarifications and corrections.  Also note that the 56 surveys completed and submitted by residents prior to this email message have already been compiled.  We thank you for your responses.
 
As we get closer to the season when we have full occupancy in the community, the Hamptons Homeowners Association (HOA) along with the Hamptons local management would like to become even more aware and responsive to your needs, wants, and concerns as residents of the Hamptons.
 
To further this goal, your HOA has sponsored the creation of the 2020 HAMPTONS RESIDENT SURVEY that asks for your input on several topics.  The goal of the survey is to use your responses as guidelines for policies, improvements, and activities you would like the HOA to pursue on your behalf. 
 
The survey (emailed to residents on Wednesday, August 5) should take less than five minutes to complete.  It is a completely confidential survey.  The survey cannot track the individuals submitting the responses - thus insuring your confidentiality.  We would like to know what is on your mind.  
 
The survey asks for your name and contact information ONLY if you would like one of our HOA Board of Directors to contact you to discuss your concerns.  Please note that any PERSONAL INFORMATION IS COMPLETELY OPTIONAL.  There are optional demographic questions at the beginning of the survey that are for demographic purposes only and not to identify any respondents.  Any information that would identify you as a respondent is COMPLETELY OPTIONAL. 
 
The responses will be compiled and categorized by a couple of residents who are technically savvy and who volunteered to design the survey and assist your HOA in this endeavor. The two are not HOA directors.  They will however be providing results of this survey to your HOA Board of Directors and ultimately presented to our overall community as applicable.
 
You can access the survey by clicking the link and using the password provided in the email you should have received on Wednesday, August 5th. This information should NOT be shared outside community residents.
 
Additionally, if you have questions about the survey or would like help completing the survey, there will be people and laptop computers in the clubhouse:
  1. 6--8 PM on Monday and Tuesday, August 10th and 11th
  2. 3--5 PM on Wednesday and Thursday, August 12th and 13th
  3. 1--3 PM on Friday, August 14th
Please note that social distancing and face masks will be required in the clubhouse ballroom area during the help sessions.
 
We ask that you answer the questions as completely and honestly as you can.  If the responses are negative – we want to know that, too.

Subject: Sale of CBD Products in the Parking Lot


I continue to receive many questions and complaints about the vendor selling CBD products in our main parking lot.  I discussed this with the Park Manager, Phil, almost two weeks ago.  He approved the vendor to sell from our parking lot on Thursdays and Fridays.   He referred to it as "an experiment."  The vendor told Phil that he has 22 customers in the Hamptons and that selling in here would help customers since they would not have to go out in the general public and risk contracting the virus.  In fact, if this experiment works out, Phil is considering expanding it to other vendors.  I mentioned that I really see some problems with this practice.  Phil said that he would reconsider based on what he hears from the residents. 
 
I know that several residents have already registered their concern to Phil over this policy.  However, I am still getting phone calls.   Phil asked for feedback from the residents, so I am asking all of you who have an opinion one way or the other to send an email to Phil voicing your opinion, for or against.  Please do not call or visit the office and leave a message for Phil.  He is much more receptive and responsive to e-mail.  His e-mail address is:

It is not required to list your HOA as an carbon copy (cc) addressee since I am pretty sure that I already know your opinions on the matter.  However, if you choose to do so, it will help the HOA in tracking our residents’ thoughts regarding the pros and cons of outside vendors coming in to set up sales areas.

Suspension of Scheduled 2020 HOA Board of Directors Meeting(s)

Hello fellow residents,
 
It has been brought to my attention that residents may not realize why the HOA BOD is not meeting at this time.  The reason is simple - we can't.  Under Florida law all Members of the HOA must be afforded the opportunity to attend and observe all meetings of the HOA BOD if a quorum of the Directors is present. 
 
The exact language of the law can be found in F.S. 723.078(2) c.1 which reads:
 
"Board of directors’ and committee meetings.--
1. Meetings of the board of directors and meetings of its committees at which a quorum is present shall be open to all members.
 
Your HOA Directors were anxious to hold meetings over the past few months but we cannot get around the clear language of the law.  The only place large enough to house the membership is the clubhouse ballroom which continues to be restricted because of the Corona virus. Your HOA BOD struggled to find an innovative way to accommodate a meeting but has been unable to find a solution.
 
However, behind the scenes, your HOA BOD has continued business as usual except for the meetings.  We are passing a lot of e-mails back and forth, talking on the phone more than usual, and meeting in small groups of two or three Directors at a time to discuss business. Your Concerns Committee and I still meet with Phil to represent your interest.  However, we can't all meet and so we cannot make any decisions on matters that require a vote without our members having an opportunity to attend.  We look forward to the day that we can meet with all of our members again. We will keep you posted.
 
On a lighter note, I would like to take this opportunity on behalf of each of the HOA Directors to wish each of you a wonderful Fourth of July weekend.  We celebrate the birth of our great nation!  A nation that was forged through unity of purpose.  These are not normal times.  We are immersed in an unprecedented number of historically significant events all at the same time.  Let us tap into the wisdom of our forefathers with faith that we can make it through all of these issues by working together.

Together we have done a remarkable job in keeping our 21.5 million people safe and preventing the worst possible outcomes. Our residents represent the most vulnerable citizens due to our age and possible medical conditions. I would expect us to continue to be prudent in our exposure to others as we proceed to resume our lifestyles.

Fellow Hamptons Residents,

Today is the first day of the Florida state-wide "Stay at Home/Safer at Home" guidance.  The initial period of this program is 30 days, although it may be extended if the situation persists.  The good news is that by obeying the guidance, each of us will be doing our part to get this virus behind us sooner. 

The media is flooded with the details of what each of us is expected to do, so I won't repeat any of it here.  Suffice it to say that the general idea is to practice social distancing.  However, some people still seem to be confused about exactly what they should be doing. 

I want to share with you the simplest, clearest guidance I have heard in the past month:  "In everything you do each day, conduct yourself as if you were already ill with the virus and you don't want to risk spreading it to anyone else." 

That's pretty clear, isn't it?

Fellow Hamptons Residents, 
 
Very early Tuesday (2:00 - 2:30 AM) there was considerable police activity in the Gladiola Drive/Petunia Way area of our community.  Several Sheriff Deputies responded and the Sheriff helicopter with a searchlight was flying overhead. We have heard from many residents who are understandably concerned about their safety.  I wish to put your fears to rest.
 
The incident actually involved an elderly resident of our community.  Apparently, he went outside and got disoriented.  The police were contacted to help find him.  They located him after about 20 minutes and they then asked Polk Fire & Rescue to take him to the hospital just to make sure he was okay. 
 
So regardless of anything you may have heard to the contrary, no one was tased; no one was handcuffed; and no crime was committed.  Nothing very exiting happened.  I know that many of you share my increasing tendency to walk into a room and get disoriented without a clue why I was there.  Well, what happened in this case was just about the same thing. Please rest assured that the community is safe.

Fellow Hamptons Residents,


It seems that all anybody is talking about right now is the Corona Virus.  People are constantly talking about it and it dominates our news.  The advice from "experts" seems to change hour-by-hour. Naturally, people are very concerned.  They wonder what's next.  In The Hamptons, we have a concentration of older people (over the age of 60) who are deemed to be most vulnerable to this disease.  Some also have medical conditions that compromise their immune system.  So it is understandable that people in The Hamptons are feeling a lot of stress and anxiety.

A few days ago Jim Boyles forwarded an e-mail to me that identified actions that 55+ communities can take to help reduce the risk of infection in their community.  The e-mail was presented from the point of the view of HOAs that run their community.  I soon realized that these were things that Sun Communities, Inc., would have to do in our situation, not your HOA.  But this stimulated my thinking.  What should Sun be doing?  What can your HOA do to be part of the solution? 

It is apparent to me that we need a single point of contact (POC) within the Hamptons to focus entirely on the Corona Virus.  Someone to act as our "Clearing House for Corona Virus information," if you will.  Therefore, I asked Conrad Gallant, as a member of the HOA Safety & Security Committee, to fill that role.  Over the last couple of days he has already been researching resources that are available to us.

Conrad’s focus will be to:
  • Act as the single POC within the HOA for residents:  He will research and maintain the latest information.  He will refer residents to sources of local, state and federal agencies that can provide the latest expert information.  He will NOT provide medical advice.
  • Make recommendations to local community manager Phil Bernhauser on actions he can take.  He will track implementation and follow-up with Phil as applicable.
  • Make recommendations to your HOA on what actions we should take.  Implement.  Follow up.
  • Keep residents informed as things change.  What should they do if . . .?  For example, if someone starts to exhibit symptoms of a cold or flu, should they go to the Emergency Room or Urgent Care and risk contaminating more people, or should they stay home and call their Doctor and do exactly what he/she tells them to do?
  • Act as HOA Host for experts from state and/or local agencies to give applicable  presentations and answer residents' questions.  Hopefully, this will be in the evening or on a weekend so that as many residents as possible can attend.  This is important because residents who work are exposed to many more people every day than the rest of us.  I am also concerned about visitors who traveled to get here and are going to Theme Parks and other places where many people congregate.  What precautions should they take?
Hopefully, through these actions, the HOA will be a resource for residents in this confusing and difficult time.  We won't have all of the answers, but we hope to direct residents to those who do have answers.  I am confident that over time, the Corona Virus problem will be resolved.  When that time comes, I hope that you can look back and say that the efforts of your HOA helped make life easier for you during this difficult time.

The Hamptons Homeowners, Inc. (Association or HOA) is a “not for profit” corporation founded in 1993. The Association was incorporated under the jurisdiction of Florida Law Statue N. 723-Mobile Home Park Tenancies. This law assures our Association the legal right to negotiate with park owners Sun Communities, Inc., their management/agents, and others on issues of common interest to homeowner members. The law also gives the Association “first right of refusal” if the park is ever offered for sale.

Additionally, the association coordinates functions such as welcoming, recycling, emergency preparedness, and other programs for the good and welfare of the community.  It provides an essential source of important information for all homeowners, membership benefits, and a channel for resolving homeowner member concerns.
